These are the General Conditions of Brasss & Haarlem Hotel Suites, registered with the Chamber of Commerce under number 34065583, registered at the address Oudeweg 8G, 2031 CC in Haarlem, VAT number NL809430502B01. These conditions apply to all services of Brasss & Haarlem Hotel Suites and to each use of the websites www.brasss-hotelsuites.nl and www.haarlem-hotelsuites.nl and underlying web pages (further: the "website").
By using the website, you agree to be bound by these Terms and Conditions. Brasss & Haarlem Hotel Suites has the right to change these General Terms and Conditions at any time, without prior notice. You are advised to review (again) these General Conditions upon repeated use.
Reservations and services
You can reserve a suite/apartment in any of our hotel through the website. All reservations must be guaranteed by a credit card valid on the date of arrival. Non-guaranteed reservations will not be accepted.
Bookings made through the website are subject to the then applicable rates. Brasss & Haarlem Hotel Suites is entitled at any time not to accept or execute a reservation, or to attach additional conditions to the acceptance or execution of a reservation.
Personal data collected from you by Brasss & Haarlem Hotel Suites will be processed in accordance with Brasss & Haarlem Hotel Suites' Privacy Statement. Please click here to consult the Privacy Statement.
You must use the services of Brasss & Haarlem Hotel Suites in accordance with applicable law, these General Terms and Conditions, accepted standards of decency and reasonable instructions from our hotels, as published on the website or provided at the hotel. It is therefore not permitted to use the services for unlawful purposes, in a manner that could damage the rights and/or interests of third parties or which, in the opinion of the Brasss & Haarlem Hotel Suites staff, could in any way damage the our hotels. If you act in violation of the foregoing, our hotels reserve the right to refuse further service to you. You shall be liable for all damages and expenses incurred by Brasss & Haarlem Hotel Suites as a result of your violation of this provision, without the necessity of any prior claim or notice of default.
Cancellation and termination
Cancellation or modification of a reservation based on the standard rate must be made no later than 23:59 (local time at the hotel location) 1 day prior to the day of arrival. Otherwise, the cost for 1 night's stay, including taxes, will be charged unless otherwise agreed upon. If a guest has booked the non-refundable rate, the full amount will be collected at all times.
As the services of Brasss & Haarlem Hotel Suites relate to accommodation and/or recreational services taking place within a certain period or on a certain date and/or time, legal regulations giving the customer the right to cancel a contract concluded at a distance without giving reasons and within a certain period do not apply to the contract concluded through the Website, nor to the services.
Payment
The rates listed on the Website include VAT and any other surcharges, unless otherwise indicated. Brasss & Haarlem Hotel Suites reserves the right to change these rates without prior notice for justifiable reasons.
In the event of failure to pay (on time), you will be in default, without the need for prior demand or notice of default. If you still fail to pay despite the claim or notice of default, Brasss & Haarlem Hotel Suites have the right to transfer the claim to a third party.
Intellectual property rights relating to the website.
You acknowledge and agree that the website contains material protected by copyright. Certain names, words, titles, phrases, logos, icons, images or designs on the pages of this website may be trade names, trademarks or service marks of Brasss & Haarlem Hotel Suites or affiliates. Under no circumstances will the total liability of Brasss & Haarlem Hotel Suites for direct damages of any kind exceed an amount of €500.
Only the following damages are considered direct damages:
damage to property;
reasonable costs associated with assessing the cause and extent of the damage, to the extent that such assessment relates to direct damage, as described in these General Terms and Conditions;
reasonable costs associated with preventing or limiting the damage, insofar as you can prove that these costs have led to a limitation of direct damage, as described in these General Terms and Conditions.
Liability of Brasss & Haarlem Hotel Suites for damages other than direct damages ("indirect damages"), including, but not limited to, moral or consequential damages, lost profits, lost opportunities, loss of information, expenses incurred in connection with this website or any website linked to it, or for damages arising out of the use or inability to use the website, software algorithms or linked websites due to interruptions, defects, delays in operation or transmission, computer viruses or line or system failures, is expressly excluded.
The limitations mentioned in the preceding paragraphs of this article shall lapse if and insofar as the damage results from intentional or deliberate recklessness on the part of Brasss & Haarlem Hotel Suites or its managers ("own acts").
A condition for any right to compensation is at all times that you must report the damage to Brasss & Haarlem Hotel Suites as soon as possible after its occurrence. Any claims for damages against Brasss & Haarlem Hotel Suites which are not submitted within a period of 6 months after the occurrence of the ground for the claim are no longer admissible.
